Why Is Another Auto Transport Company Using My Company Name?

Last week I spent about an hour speaking with FMCSA representatives about companies using my business name. Then I found a Montway Auto Transport page headlined “#1 Enterprise Auto Transport.” Enterprise Auto Transport is my company — I have operated under this name since 2012. Here is what I found, what federal broker rules say, and how consumers can verify who they are actually dealing with.

Verify before you book

Two minutes on the FMCSA website tells you who you're really dealing with

You do not have to take any company's word for it. The Federal Motor Carrier Safety Administration keeps free public records on every licensed broker and carrier in the country. Here is exactly what to ask for and where to verify it:

  1. 1.Ask for the MC and USDOT numbers

Every legitimate broker and carrier must provide both on request. Our numbers: USDOT #2273104 and MC #774106. If a company hesitates or deflects, stop.

  2. 2.Look them up on the FMCSA SAFER system

Go to safer.fmcsa.dot.gov and use the Company Snapshot search. Enter the MC or USDOT number and confirm the legal name, operating status and “Authorized” broker or carrier authority match what you were told.

  3. 3.Confirm the $75,000 broker bond

In the FMCSA Licensing & Insurance portal (li-public.fmcsa.dot.gov), verify the broker's BMC-84 bond or BMC-85 trust fund is active. No active bond means no legal authority to broker your shipment.

  4. 4.Request the carrier's insurance certificate

Before your car is loaded, ask for a certificate of insurance directly from the assigned carrier — cargo and liability. Match the carrier's name and DOT number on the certificate to the truck that arrives.

When you check our records you'll find Enterprise Auto Transport, USDOT #2273104, MC #774106 — an owner-operated, federally licensed and bonded broker with offices in Naples, Florida and Minnesota. You can also read our full carrier vetting process.

A note from the owner

Last week, I spent about an hour speaking with representatives at the FMCSA about companies using my business name, impersonating my company, or otherwise creating confusion about who consumers are actually doing business with.

A few days later, one of the representatives I spoke with contacted me and asked me to provide a list of companies and situations I believe warrant review for potentially fraudulent or misleading activity in the auto transport industry.

Apparently, I forgot one.

A Montway Auto Transport page displayed the headline: “#1 Enterprise Auto Transport.” Then I found the screenshot below — a Montway Auto Transport paid advertisement on Google showing the same wording: “#1 Enterprise Auto Transport | Use Our Quick Quote Calculator,” with the URL montway.com/Enterprise/Car-Transport.

Enterprise Auto Transport is my company. I have operated under this name since 2012. I am a small, independent auto transport brokerage. I have spent years building this name, our reputation, our customer relationships, and our presence online.

So I have a very simple question: why is another auto transport brokerage displaying “Enterprise Auto Transport” so prominently on its website?

Whether this resulted from advertising technology, dynamically generated content, SEO targeting, a website error, or something else, I believe consumers deserve to know exactly which licensed broker they are dealing with.

Operating under someone else's authority and misleading consumers about the identity of a licensed transportation broker are serious matters. I am not claiming that the screenshot, by itself, proves either occurred. I am documenting what I found and asking that the appropriate people review it. I will be adding this screenshot and the underlying information to the material I am providing for review.

Competition is part of business. Using another broker's established business name in a way that could confuse consumers is something entirely different.

The facts, from public federal records

I believe consumers deserve verifiable facts rather than accusations, so here is the public federal record. Enterprise Auto Transport is federally registered with the FMCSA as USDOT #2273104 and MC #774106 — the name on our broker bond, our BBB accreditation, and the name our customers have known since February 2012.

Montway operates as MONTWAY LLC, doing business as Montway Auto Transport, out of the Chicago/Schaumburg, Illinois area. FMCSA records list the company under USDOT Number 2239816 and MC-611862, with authorized property broker authority.

That means Montway is a licensed broker operating under its own federal authority — a separate legal entity, with a separate USDOT number, a separate MC number, and a separate bond. Two different companies. Two different sets of federal numbers. One name being used in an advertisement.

We have no affiliation with Montway LLC. We are not a Montway brand, agent, partner, or subsidiary. We have never authorized Montway or any other company to use our name in advertising, on a landing page, or in a quote form.

  • Enterprise Auto Transport — USDOT #2273104, MC #774106, Naples, Florida. Only booking number: (239) 273-4649.
  • Montway LLC (DBA Montway Auto Transport) — USDOT 2239816, MC-611862, Illinois. Not affiliated with us in any way.

No company may operate under another company's authority

This is the part that consumers rarely hear about, and it is the reason I take a headline like this seriously.

Federal law requires every property broker to register with the FMCSA in its own name, obtain its own MC number, and carry its own surety bond before arranging a single shipment (49 U.S.C. §13904 and 49 U.S.C. §13901). Brokerage cannot be borrowed, shared, subcontracted, or rented. Operating transportation arrangements under a name or authority that is not yours is not a paperwork technicality — it is unauthorized brokerage, and it is exactly what the registration system exists to prevent.

FMCSA's broker regulations go further. Under 49 CFR §371.7, a broker may not perform or offer brokerage service “in any name other than that in which its registration is issued,” and may not misrepresent its identity or the nature of its operations.

So when any advertisement puts one registered company's name at the top of another registered company's quote form, the questions that follow are legitimate: whose authority is the consumer actually contracting under, whose bond protects the deposit, and whose insurance responds if something goes wrong? A consumer who believes they hired us has no claim against us for a shipment we never booked.

How to make sure you are actually talking to Enterprise Auto Transport

Verification takes a few minutes and protects your deposit, your vehicle, and your personal information.

  • Our only website is enterpriseautotransport.com. Our local city pages always display our logo and our FMCSA numbers with a link to our federal record.
  • Our only booking phone number is (239) 273-4649. If you called a different number, you did not reach us.
  • If the person on the phone is not Rena, you are not speaking with Enterprise Auto Transport.
  • Check the numbers before you pay anyone: USDOT 2273104 / MC 774106 on FMCSA SAFER. Any other numbers belong to a different company.
  • Never send a deposit until you have confirmed the company name, the USDOT number, and the MC number on the federal record — not on the website that is asking for the money.

Why we are speaking up

Enterprise Auto Transport has been in business since 2012. We built our name ourselves, and we intend to protect it.

Key takeaways

  • A Montway Auto Transport page carried the headline “#1 Enterprise Auto Transport.” We are not affiliated with Montway and did not authorize the use of our name.
  • FMCSA records list Montway LLC under USDOT 2239816 / MC-611862. Enterprise Auto Transport is USDOT #2273104 / MC #774106. Two separate registrants.
  • Federal law (49 U.S.C. §13904, 49 CFR §371.7) requires every broker to register and operate in its own name under its own authority and bond. Authority cannot be borrowed or shared.
  • If the name on the page and the operating numbers on the contract do not match, stop and verify before paying anything.
  • Our only booking number is (239) 273-4649, and our only website is enterpriseautotransport.com.
